Terms of Use

Before It Fades · Effective date: November 5, 2026

These Terms of Use (“Terms”) govern your use of Before It Fades (the “App”), provided by Denys Prachev (“we”, “us”, or “our”). Contact: beforeitfades.app@gmail.com.

By using the App, you agree to these Terms to the extent an agreement can validly be formed under applicable law. If you do not agree, please do not use the App. Our Privacy Policy explains how information is handled; accepting these Terms does not constitute consent to optional data processing.

1. What Before It Fades provides

Before It Fades is a personal diary with memories, a calendar, life chapters, custom chapter names, character personalisation, and letters to your future self. Features may also include local reminders, a home-screen widget, and backup export and restoration.

The App does not require a Before It Fades account. Your diary is stored locally, subject to the backup and platform arrangements described in the Privacy Policy. The App is not a public posting platform or a messaging service to other people. Its “send”, “delivery”, and envelope features refer to letters saved for you within the App.

2. Eligibility

You must be legally able to enter into these Terms or have the involvement and permission of a parent or legal guardian where required. Your use must comply with applicable minimum-age rules, local law, and the requirements of the store from which you obtain the App. The App is not specifically designed or marketed for children.

3. Permission to use the App

Subject to these Terms and applicable store rules, you receive a limited, non-exclusive licence to use the App for your own personal use on devices you lawfully own or control. The licence does not transfer ownership of the App or its artwork, software, sounds, branding, or other materials.

You may not distribute unauthorised copies, bypass purchase restrictions, introduce malicious code, or interfere with the App or store services. Restrictions on reverse engineering or modification apply only to the extent permitted by law and do not limit rights that applicable law or an applicable open-source licence gives you.

For the iOS version, Apple’s Standard Licensed Application End User License Agreement also applies. These Terms supplement that agreement and the relevant store terms; they do not replace Apple’s standard licence with a custom EULA. Mandatory law and applicable store usage rules continue to apply.

4. Your writing and personal choices

You retain your rights in the memories, letters, and custom chapter names you create. You do not grant us a licence to publish your diary, use it in advertising, or train AI models with it. The App processes locally stored content as necessary to provide the features you use. If you voluntarily send content to support, we may use it only as reasonably necessary to handle your request and related obligations described in the Privacy Policy.

You are responsible for having the right to store, import, or share the material you choose. This does not prevent you from writing honestly about difficult feelings or personal experiences in your private diary. We do not routinely review or moderate locally stored diary entries.

Avatar and partner selections are illustrative personalisation choices. They do not verify your identity or another person’s identity and do not create a representation about your real-world relationships.

5. Personal reflection, not professional care

The App’s prompts, chapter names, questions, illustrations, and messages are intended for journaling and personal reflection. They do not provide medical, psychological, legal, or other professional advice, diagnosis, treatment, or a promise of improvement in your wellbeing.

Your diary is not monitored by us for emergencies or requests for help. If you need urgent assistance, contact an appropriate local emergency service or qualified professional. Do not rely on an App entry, future letter, or reminder to obtain emergency help.

6. Free features and Premium

The App offers free features and optional Premium access. In the currently reviewed version, the free tier allows one newly saved memory per day, up to 300 characters per memory or future letter, and up to three active future letters. Premium removes these particular writing and quantity limits, subject to technical and device limits. Features and availability may vary by App version and platform; review the App’s current plan description before purchasing.

Premium may be offered through a monthly subscription, a yearly subscription, or a one-time Lifetime purchase. Not every plan or promotional offer is necessarily available in every store or region. The App and the store purchase screen identify the plan, included features, billing period, price, and any trial or introductory offer before you confirm a purchase. The store confirmation controls the amount charged for that transaction.

We do not require you to purchase Premium to retrieve a store entitlement that you already validly own through the same store account.

7. Payments, subscriptions, and trials

Payments are processed by Apple or Google through the store account used for the purchase. Their payment terms apply in addition to these Terms. Prices, currencies, and applicable taxes are displayed by the store. We do not collect payment-card details directly.

Monthly and yearly subscriptions renew automatically unless cancelled under the applicable store’s rules. The store charges the selected payment method at the applicable subscription rate. A trial or introductory offer applies only if it is offered to you and confirmed by the store. Unless the offer says otherwise, a trial converts to a paid subscription if you do not cancel within the store’s required cancellation period.

On Apple platforms, cancel a free or discounted trial at least 24 hours before it ends if you do not want it to renew. For all plans, check the deadline and status shown in your store account rather than waiting until the last moment. Trial length, eligibility, renewal price, and billing terms are those shown to you for the actual offer; these Terms do not promise a trial to every user.

You can manage or cancel subscriptions through the App’s subscription-management link, if available, or directly through:

Apple subscription settings and instructions

Google Play subscription settings and instructions

Uninstalling the App, deleting diary content, or contacting support does not by itself cancel store billing. After cancellation, access normally continues for the remainder of the paid period, subject to store rules, refunds, and applicable law. Changes to subscription pricing will follow applicable law and the store’s required notice and consent procedures.

8. Lifetime purchases

If offered, Lifetime is a one-time, non-renewing purchase of Premium access for the ongoing supported life of the App. It does not create recurring subscription charges and does not promise your biological lifetime, perpetual availability of a discontinued service, every future separate product, or permanent compatibility with every future device or operating system.

This description does not allow us to arbitrarily revoke a valid purchase or remove mandatory consumer remedies. If we materially change or discontinue a paid offering, applicable law and store rules govern any notice, continued access, refund, or other remedy.

Buying Lifetime does not necessarily cancel an existing monthly or yearly subscription. Check and cancel any unwanted subscription separately in the relevant store to avoid overlapping payments.

9. Restoring purchases and refunds

Use Restore Purchases, where available, with the store account used for the original purchase. A store connection may be required to purchase, restore, or verify Premium. Restoring a purchase restores the access right; it does not recover locally stored diary content.

A diary backup does not transfer a subscription or Lifetime entitlement. Because the App has no cross-platform account linking purchases, a purchase in the App Store is not automatically recognised as a Google Play purchase, or vice versa. Family sharing and other purchase-sharing features apply only where supported by the product and store.

Refunds are governed by applicable consumer law and the relevant store’s refund procedures. These Terms do not impose a blanket “no refunds” rule or remove any statutory withdrawal, warranty, or refund rights. You can use the store’s refund process or contact beforeitfades.app@gmail.com for assistance. A refund, expiry, or revocation may end the corresponding Premium entitlement.

10. What happens when Premium ends

Subscription cancellation or expiry does not itself delete memories or letters already stored in the App. Free-tier restrictions can apply to new writing, editing, or creation of additional items after Premium access ends. Existing stored content is still subject to the ordinary deletion, backup, compatibility, and storage limitations described in these Terms.

Premium is not a separate cloud-storage or disaster-recovery service. Paying for Premium does not allow us to recover writing that was stored only on a device you can no longer access.

11. Future letters and reminders

A future letter opens according to the date or chapter conditions you choose and the App’s implemented delivery rules. Chapter letters can depend on entering a particular chapter, a later eligible day, repeat settings, and subsequent App use. A chapter title describes your own selection; the App does not independently detect your emotional state or real-life events.

Letter availability and notifications depend on device date and time, operating-system behaviour, permissions, notification settings, and App activity. We do not guarantee delivery at an exact minute or that a notification will appear. A notification is separate from whether a saved letter becomes available inside the App.

Future-letter restrictions and sealed envelopes are experience features, not a secure time-lock or encryption system. They are not suitable for storing information that must remain inaccessible until a legally or financially important date.

12. Local data, backup responsibilities, and deletion

You are responsible for protecting your device and keeping independent backups of writing you want to retain. Device loss, uninstalling the App, clearing its data, a failed system restore, hardware damage, insufficient storage, or software errors can affect local information. We do not guarantee recovery of data that we do not hold.

The App can create local safety copies and lets you export supported diary data to a backup file. A local copy on the same phone is not a replacement for a copy saved outside the App. Export files are not password protected or encrypted by the App. Review the destination and sharing settings before placing a backup in a cloud account or giving it to another person.

Restoration merges supported information rather than necessarily replacing the entire diary. An old backup can reintroduce previously deleted entries. Deleting an item in the diary does not erase prior exports or every local, system, or cloud copy. Consult the Privacy Policy for details on deletion and retention.

There are practical limits on file size, available storage, and supported backup versions. Do not assume that every setting, permission, or store entitlement is included in a backup. Protect your backups before changing devices or making major changes to the App or its data.

13. Intellectual property and third-party services

The App and its original software, presentation, text, branding, and other materials are protected by applicable intellectual-property law. Rights in third-party components remain with their respective owners and are subject to their applicable licences. Nothing in these Terms restricts your rights in your own writing.

App stores, device operating systems, cloud storage, email, and other third-party services are provided by their respective operators. Their terms apply when you use them. We are responsible for our own obligations concerning the App; we do not control a third party’s independent service or its availability.

14. Updates and changes

We may release fixes, improvements, and changes to the App. Some features require a compatible device, operating system, current App version, or store connection. Where reasonably practicable, back up important writing before installing a major update or moving to a new device.

If we make a material change to these Terms or a paid feature, we will give notice and obtain agreement where applicable law requires it. Revised Terms apply prospectively and do not remove rights or remedies relating to an earlier purchase. If you do not accept a future change, you may stop using the App and cancel renewal, without losing rights that mandatory law gives you.

15. Warranties and responsibility

We aim to provide a functional App, but do not promise uninterrupted operation, compatibility with every device, error-free software, or exact reminder delivery. To the extent permitted by law, the App is provided on an “as available” basis without additional promises beyond those expressly stated or required by law.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct, or other matters protected by mandatory law. Mandatory consumer guarantees, digital-content rights, and remedies remain available. We remain responsible for harm to the extent required by applicable law; a backup recommendation does not waive that responsibility.

16. Ending use, applicable law, and contact

You can stop using the App at any time. To stop a subscription from renewing, cancel it separately through the relevant store. Removing the App does not delete independently retained backup files or cancel billing.

These Terms are subject to applicable law. Nothing in them deprives you of mandatory protections or access to courts available under the law of your country of residence. Disputes may be brought before the courts that have jurisdiction under applicable law. No mandatory arbitration clause or class-action waiver is imposed by these Terms. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
